Islam and Domestic Violence By Hassan El-Najjar Khutba for Friday Prayer, 25 Safar, 1430, February 20, 2009 æóãöäú ÂíóÇÊöåö Ãóäú ÎóáóÞó áóßõãú ãöäú ÃóäúÝõÓößõãú ÃóÒúæóÇÌðÇ áöÊóÓúßõäõæÇ ÅöáóíúåóÇ æóÌóÚóáó Èóíúäóßõãú ãóæóÏøóÉð æóÑóÍúãóÉð Åöäøó Ýöí Ðóáößó áÂíóÇÊò áöÞóæúãò íóÊóÝóßøóÑõæäó (Al-Room, 30.21)And of His signs: He has created for you from yourselves mates with whom you find rest , and He ordained between you love and mercy . In this, there are signs for people who ponder . (Al-Room, 30.21)

(Al-Nisssa, 4: 1)
æóíóÓۡÜٔóáõæäóßó Úóäö ٱáۡãóÍöíÖö�ۖ Þõáۡ åõæó ÃóÐð۬ì ÝóٱÚۡÊóÒöáõæÇú ٱáäøöÓóÇٓÁó Ýöì ٱáۡãóÍöíÖö�ۖ æóáóÇ ÊóÞۡÑóÈõæåõäøó ÍóÊøóìٰ íóØۡåõÑۡäó�ۖ ÝóÅöÐóÇ ÊóØóåøóÑۡäó ÝóÃۡÊõæåõäøó ãöäۡ ÍóíۡËõ ÃóãóÑóßõãõ ٱááøóåõ�ۚ Åöäøó ٱááøóåó íõÍöÈøõ ٱáÊøóæøóٲÈöíäó æóíõÍöÈøõ ٱáۡãõÊóØóåøöÑöíäó (2: 222) They ask thee concerning women's courses. Say: They are a hurt and a pollution; so keep away from women in their courses, and do not approach them until they are clean. But when they have purified themselves, ye may approach them in any manner, time or place ordained for you by Allah. for Allah loves those who turn to Him constantly and He loves those who keep themselves pure and clean. (2: 222) äöÓóÇٓÄõßõãۡ ÍóÑۡËñ۬ áøóßõãۡ ÝóÃۡÊõæÇú ÍóÑۡËóßõãۡ Ãóäøóìٰ ÔöÆۡÊõãۡ�ۖ æóÞóÏøöãõæÇú áöÃóäÝõÓößõãۡ�ۚ æóٱÊøóÞõæÇú ٱááøóåó æóٱÚۡáóãõæٓÇú Ãóäøóڪõã ãøõáóÜٰÞõæåõ�ۗ æóÈóÔøöÑö ٱáۡãõÄۡãöäöíäó (Al-Baqara, 2: 223) Your wives are as a tilth unto you; so approach your tilth when or how ye will. but do some good act for your souls beforehand; and fear Allah, and know that ye are to meet Him (in the Hereafter) and give (these) good tidings to those who believe. (Al-Baqara, 2: 223) íóÜٰٓÃóíøõåóÇ ٱáøóÐöíäó ÁóÇãóäõæÇú áóÇ íóÍöáøõ áóßõãۡ Ãóä ÊóÑöËõæÇú ٱáäøöÓóÇٓÁó ßóÑۡåð۬Ç�ۖ æóáóÇ ÊóÚۡÖõáõæåõäøó áöÊóÐۡåóÈõæÇú ÈöÈóÚۡÖö ãóÇٓ ÁóÇÊóíۡÊõãõæåõäøó ÅöáøóÇٓ Ãóä íóÃۡÊöíäó ÈöÝóÜٰÍöÔóÉò۬ ãøõÈóíøöäóÉò۬�ۚ æóÚóÇÔöÑõæåõäøó ÈöٱáۡãóÚۡÑõæÝö�ۚ ÝóÅöä ßóÑöåۡÊõãõæåõäøó ÝóÚóÓóìٰٓ Ãóä ÊóßۡÑóåõæÇú ÔóíۡÜٔð۬Ç æóíóÌۡÚóáó ٱááøóåõ Ýöíåö ÎóíۡÑð۬Ç ڪóËöíÑð۬Ç O ye who believe! ye are forbidden to inherit women against their will. Nor should ye treat them with harshness, that ye may take away part of the dower ye have given them,― except where they have been guilty of open lewdness; on the contrary live with them on a footing of kindness and equity. If ye take a dislike to them, it may be that ye dislike a thing and Allah brings about through it a great deal of good. (Al-Nissa, 4: 19) ٱáÑøöÌóÇáõ Þóæøóٲãõæäó Úóáóì ٱáäøöÓóÇٓÁö ÈöãóÇ ÝóÖøóáó ٱááøóåõ ÈóÚۡÖóåõãۡ Úóáóìٰ ÈóÚۡÖò۬ æóÈöãóÇٓ ÃóäÝóÞõæÇú ãöäۡ Ãóãۡæóٲáöåöãۡ�ۚ ÝóٱáÕøóÜٰáöÍóÜٰÊõ ÞóÜٰäöÊóÜٰÊñ ÍóÜٰÝöÙóÜٰÊñ۬ áøöáۡÛóíۡÈö ÈöãóÇ ÍóÝöÙó ٱááøóåõ�ۚ æóٱáøóÜٰÊöì ÊóÎóÇÝõæäó äõÔõæÒóåõäøó ÝóÚöÙõæåõäøó æóٱåۡÌõÑõæåõäøó Ýöì ٱáۡãóÖóÇÌöÚö æóٱÖۡÑöÈõæåõäøó�ۖ ÝóÅöäۡ ÃóØóÚۡäóڪõãۡ ÝóáóÇ ÊóÈۡÛõæÇú ÚóáóíۡÀöäøó ÓóÈöíáÇð�ۗ Åöäøó ٱááøóåó ßóÇäó Úóáöíøð۬Ç ڪóÈöíÑð۬Ç (Al-Nissa, 4: 34)Men are the protectors and maintainers of women, because Allah has given the one more (strength) than the other, and because they support them from their means. Therefore the righteous women are devoutly obedient, and guard in (the husband's) absence what Allah would have them guard. As to those women on whose part ye fear disloyalty and ill-conduct, admonish them (first), (next), refuse to share their, beds (and last) beat them (lightly); but if they return to obedience, seek not against them means (of annoyance): for Allah is Most High, Great (above you all). (Al-Nissa, 4: 34)æóÅöäۡ ÎöÝۡÊõãۡ ÔöÞóÇÞó ÈóíۡäöÀöãóÇ ÝóٱÈۡÚóËõæÇú Íóßóãð۬Ç ãøöäۡ Ãóåۡáöåöۦ æóÍóßóãð۬Ç ãøöäۡ ÃóåۡáöåóÇٓ Åöä íõÑöíÏóÇٓ ÅöÕۡáóÜٰÍð۬Ç íõæóÝøöÞö ٱááøóåõ ÈóíۡäóÀõãóÇٓ�ۗ Åöäøó ٱááøóåó ßóÇäó ÚóáöíãðÇ ÎóÈöíÑð۬Ç (Al-Nissa, 4: 35)===================================================== Divorce: ÓõæۡÑóÉõ ÇáØøáÇóÞ íóÜٰٓÃóíøõÀóÇ ٱáäøóÈöìøõ ÅöÐóÇ ØóáøóÞۡÊõãõ ٱáäøöÓóÇٓÁó ÝóØóáøöÞõæåõäøó áöÚöÏøóÊöÀöäøó æóÃóÍۡÕõæÇú ٱáۡÚöÏøóÉó�ۖ æóٱÊøóÞõæÇú ٱááøóåó ÑóÈøóڪõãۡ�ۖ áóÇ ÊõÎۡÑöÌõæåõäøó ãöäۢ ÈõíõæÊöåöäøó æóáóÇ íóÎۡÑõÌۡäó ÅöáøóÇٓ Ãóä íóÃۡÊöíäó ÈöÝóÜٰÍöÔóÉò۬ ãøõÈóíøöäóÉò۬�ۚ æóÊöáۡßó ÍõÏõæÏõ ٱááøóåö�ۚ æóãóä íóÊóÚóÏøó ÍõÏõæÏó ٱááøóåö ÝóÞóÏۡ Ùóáóãó äóÝۡÓóåõ ۥ�ۚ áóÇ ÊóÏۡÑöì áóÚóáøó ٱááøóåó íõÍۡÏöËõ ÈóÚۡÏó Ðóٲáßó ÃóãۡÑÇ ÝóÅöÐóÇ ÈóáóÛۡäó ÃóÌóáóåõäøó ÝóÃóãۡÓößõæåõäøó ÈöãóÚۡÑõæÝò Ãóæۡ ÝóÇÑöÞõæåõäøó ÈöãóÚۡÑõæÝò۬ æóÃóÔۡÀöÏõæÇú Ðóæóìۡ ÚóÏۡáò۬ ãøöäßõãۡ æóÃóÞöíãõæÇú ٱáÔøóåóÜٰÏóÉó áöáøóåö�ۚ Ðóٲáöڪõãۡ íõæÚóÙõ Èöåöۦ ãóä ßóÇäó íõÄۡãöäõ Èöٱááøóåö æóٱáۡíóæۡãö ٱáۡÃóÎöÑö�ۚ æóãóä íóÊøóÞö ٱááøóåó íóÌۡÚóá áøóåõ ۥ ãóÎۡÑóÌð۬Ç æóíóÑۡÒõÞۡåõ ãöäۡ ÍóíۡËõ áóÇ íóÍۡÊóÓöÈõ�ۚ æóãóä íóÊóæóßøóáۡ Úóáóì ٱááøóåö Ýóåõæó ÍóÓۡÈõåõ ۥۤ�ۚ Åöäøó ٱááøóåó ÈóÜٰáöÛõ ÃóãۡÑöåöۦ�ۚ ÞóÏۡ ÌóÚóáó ٱááøóåõ áößõáøö ÔóìۡÁò۬ ÞóÏۡÑð۬Ç æóٱáøóÜٰٓÜٔöì íóٮٕöÓۡäó ãöäó ٱáۡãóÍöíÖö ãöä äøöÓóÇٓٮٕößõãۡ Åöäö ٱÑۡÊóÈۡÊõãۡ ÝóÚöÏøóÊõÀõäøó ËóáóÜٰËóÉõ ÃóÔۡåõÑò۬ æóٱáøóÜٰٓÜٔöì áóãۡ íóÍöÖۡäó�ۚ æóÃõæúáóÜٰÊõ ٱáۡÃóÍۡãóÇáö ÃóÌóáõåõäøó Ãóä íóÖóÚۡäó Íóãۡáóåõäøó�ۚ æóãóä íóÊøóÞö ٱááøóåó íóÌۡÚóá áøóåõ ۥ ãöäۡ ÃóãۡÑöåöۦ íõÓۡÑð۬Ç Ðóٲáößó ÃóãۡÑõ ٱááøóåö ÃóäÒóáóåõ ۥۤ Åöáóíۡßõãۡ�ۚ æóãóä íóÊøóÞö ٱááøóåó íõßóÝøöÑۡ Úóäۡåõ ÓóíøöÜٔóÇÊöåöۦ æóíõÚۡÙöãۡ áóåõ ۥۤ ÃóÌۡÑðÇ ÃóÓۡßöäõæåõäøó ãöäۡ ÍóíۡËõ ÓóßóäÊõã ãøöä æõÌۡÏößõãۡ æóáóÇ ÊõÖóÇٓÑøõæåõäøó áöÊõÖóíøöÞõæÇú ÚóáóíۡÀöäøó�ۚ æóÅöä ßõäøó ÃõæúáóÜٰÊö Íóãۡáò۬ ÝóÃóäÝöÞõæÇú ÚóáóíۡÀöäøó ÍóÊøóìٰ íóÖóÚۡäó Íóãۡáóåõäøó�ۚ ÝóÅöäۡ ÃóÑۡÖóÚۡäó áóßõãۡ ÝóÜٔóÇÊõæåõäøó ÃõÌõæÑóåõäøó�ۖ æóÃۡÊóãöÑõæÇú Èóíۡäóßõã ÈöãóÚۡÑõæÝò۬�ۖ æóÅöä ÊóÚóÇÓóÑۡÊõãۡ ÝóÓóÊõÑۡÖöÚõ áóåõ ۥۤ ÃõÎۡÑóìٰ
Al-Talaq (65)
In the name of Allah, the Beneficent, the Merciful
O Prophet! when ye do divorce women, divorce them
at their prescribed periods, and count (accurately), their
prescribed periods: and fear Allah your Lord: and turn them not out
of their houses, nor shall they (themselves) leave, except in case
they are guilty of some open lewdness. Those are limits set by
Allah: and any who transgresses the limits of Allah, does verily
wrong his (own) soul: thou knowest not if perchance Allah will bring
about thereafter some new situation. (1)
Hadeeth:Thus when they fulfil their term appointed, either take them back on equitable terms or part with them on equitable terms; and take for witness two persons from among you, endued with justice, and establish the evidence (as) before Allah. Such is the admonition given to him who believes in Allah and the Last Day. And for those who fear Allah, He (ever) prepares a way out (2) And He provides for him from (sources) he never could imagine. And if anyone puts his trust in Allah, sufficient is (Allah) for him. For Allah will surely accomplish His purpose: verily, for all things has Allah appointed a due proportion. (3) Such of your women as have passed the age of monthly courses, for them the prescribed period, if ye have any doubts, is three months, and for those who have no courses (it is the same): for those who carry (life within their wombs) their period is until they deliver their burdens: and for those who fear Allah, He will make their path easy. (4) That is the Command of Allah which He has sent down to you: And if anyone fears Allah He will remove his ills from him, and will enlarge His reward. (5) Let the women live (in 'iddah) in the same style as ye live, according to your means: annoy them not, so as to restrict them. And if they carry (life in their wombs), then spend (your substance) on them until they deliver their burden: and if they suckle your (offspring), give them their recompense: and take mutual counsel together, according to what is just and reasonable. And if ye find yourselves in difficulties let another woman suckle (the child) on the (father's) behalf. (6) Statistics about domestic violence in the US: Intimate Partner Violence
